By downloading, using, installing the Healyn Application (Healyn and/or Healyn Application) or registering with or accessing the Folds Application, these terms and conditions (Terms and Conditions) will automatically apply to you. Additionally, you must accept the terms and conditions electronically when registering with the Healyn application. This acceptance is a formal requirement for this agreement, and your acceptance through electronic means or use of the application will bind you to this agreement. Therefore, you should make sure you have carefully read these before using the Healyn Application.
The Healyn Application offers services (Services) to generate responses and content for users using artificial intelligence algorithms in response to texts, documents, and images you add.
These Terms and Conditions grant you the right to use the Healyn Application only for the purpose of benefiting from the Services within the scope defined herein. You are not permitted to copy or modify the Healyn Application, any part of the Healyn Application, or our trademarks in any way. You are not permitted to attempt to extract the source code of the Healyn Application, and you may not translate or create derivative versions of the Healyn Application. The Healyn Application itself, and all related trademarks, copyrights, database rights, and other associated intellectual property rights belong to Folds Dijital Hizmetler Anonim Sirketi (Folds).
Folds aims to ensure that the Healyn Application is as useful and efficient as possible. For this reason, we reserve the right to make changes to the Healyn Application or charge for the Application's services at any time and for any reason.
The Healyn Application stores and processes personal data that you have provided to us to provide our Service. It is your responsibility to keep your phone and access to the Healyn Application secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by your device's official operating system. This could make your phone vulnerable to malware, viruses, or malicious programs, compromise your phone's security features, and could mean that the Healyn Application may not work properly or at all.
You should be aware that there are certain things that Folds will not take responsibility for. Certain functions of the Healyn Application require the Healyn Application to have an active internet connection. This connection may be Wi-Fi or provided by your mobile network provider; however, if you do not have access to Wi-Fi and have no remaining data allowance, Folds cannot take responsibility if the Healyn Application does not work at full functionality.
If you are using the Healyn Application outside of a Wi-Fi area, please note that the terms of your agreement with your mobile network provider will apply. As a result, you may be charged by your mobile provider for the cost of data during the connection time while accessing the Healyn Application or other third-party costs. By using the Healyn Application, you accept responsibility for any such charges, including data roaming charges, if you use the Healyn Application outside your home region (e.g., another region or country) without turning off data roaming. Please note that if you are not the bill payer for the device on which you are using the Healyn Application, we assume you have received permission from the bill payer to use the Healyn Application.
Similarly, Folds does not take responsibility for the way you use the Healyn Application. In other words, you need to make sure that your device is charged. If your device's battery runs out and you cannot turn it on to use the Folds Service, Folds cannot accept responsibility.
Regarding Folds' responsibility for your use of the Healyn Application, while we endeavor to ensure that the application is always up to date and accurate when you use the Healyn Application, please note that we rely on third parties to provide information to us so that we can make it available to you. Folds accepts no liability for any direct or indirect loss you may experience as a result of relying entirely on the functionality of the Healyn Application.
At any time, we may wish to update the Healyn Application. The Healyn Application is currently available on iOS and Android. The requirements of the systems (and any additional systems we decide to extend the availability of the application to) may change, and you will need to download updates if you want to continue using the Healyn Application. Folds does not promise that it will always update the Healyn Application to be compatible with you or to work with the iOS or Android version you have installed on your device. However, you commit to always accepting application updates when offered to you.
We may also wish to stop providing the Healyn Application and may terminate use at any time without giving you notice of termination. Unless we tell you otherwise, upon termination of use, the rights and licenses granted to you in these terms will end, and you will have to stop using the Healyn Application and delete it from your device if necessary.
With or through our Services, you may provide, upload, transmit, create, store, use, edit, or share content such as texts, sentences, recordings, information, questions, queries, links, documents, audio recordings, images, photographs, audiovisual recordings, graphics, materials, and other data (Input). Additionally, you may obtain content such as texts, sentences, responses, links, documents, images, photographs, audiovisual recordings, and other data generated, created, or provided in response through the Services (Output). Input and Output are collectively referred to as "User-Generated Content."
You may upload, transmit, create, store, use, edit, and share User-Generated Content only if it complies with these Terms and Conditions (including the Folds End User License Agreement) and applicable laws.
You acknowledge, represent, and warrant that you own the Input; that you have the necessary consent, permission, licenses, and rights to create or license the Input subject to these Terms and Conditions; and that you have the necessary legal capacity in the relevant jurisdiction to create or license the Input and to be a party to these Terms and Conditions.
From the moment you upload or transmit the Input, you grant us a non-exclusive, irrevocable, fully paid, royalty-free, perpetual, sublicensable, transferable, worldwide license and right to store, use, communicate to the public, reproduce, modify, create derivative works, record, sublicense, translate, transmit, publish, publicly display, or otherwise exploit the User-Generated Content in any format, by any means, and with all technologies known or later developed, solely for the purposes of operating, developing, troubleshooting, debugging, maintaining, and customizing Folds and its affiliates' current or future products (including but not limited to Healyn AI learning) and developing new features or future products, without any notice, permission, fee, or additional compensation to you or third parties.
Healyn does not endorse, certify, verify, or control User-Generated Content. The User shall be exclusively and strictly liable for the User-Generated Content and the consequences of sharing or publishing such content in any way, including ensuring that User-Generated Content does not violate applicable law, third-party rights, or these Terms and Conditions (including the Folds End User License Agreement).
You confirm and agree that you do not violate the rights and privacy of third parties when using the Healyn application. Furthermore, you represent and acknowledge that you are aware that Folds will not be liable or responsible in any way for literary works, sentences, inputs, texts, or materials that may be subject to copyright and other materials provided through User-Generated Content or Services.
You may not upload, transmit, create, store, edit, use, or share User-Generated Content that violates these Terms and Conditions (including the Folds End User License Agreement) or applicable laws. Additionally, you may not use the Healyn Application in violation of these provisions.
Furthermore, you may not use or benefit from the Healyn Application for the purpose of developing models that could compete with the Healyn Application.
In accordance with Article 15 (Indemnification) of the Folds End User License Agreement, you agree to indemnify and hold harmless the Indemnified Parties (as defined in the Folds End User License Agreement) from claims containing allegations that User-Generated Content directly or indirectly infringes the intellectual property rights of a third party, or arising from violations of these Terms and Conditions or applicable law, directly or indirectly.
You represent and acknowledge that you are aware of and accept the following:
(i) Output is generated by Artificial Intelligence; (ii) Output may be incorrect, erroneous, or misleading; (iii) Folds makes no representation or warranty that the Output is accurate, true, or correct, or that it is suitable for your use or needs; (iv) Output is in no way advice or information provided by Folds and in no way reflects the opinion of Folds; (v) Folds is in no way under any obligation or liability regarding the Output; (vi) Your use of the Output is entirely at your own risk; (vii) You should not rely on the Healyn Application and Output as your sole source of information.
Folds is not responsible for any damages arising from or in connection with the Output, including but not limited to lost profits, loss of revenue, loss of time, loss of use, data or reputation, emotional distress, or any direct, indirect, incidental, special, consequential damages, or punitive damages under any other legal theory, including contract, tort, strict liability, and negligence.
In addition, you represent and acknowledge that you are aware that the Output may not always be original and that similar or identical outputs may be generated in response to similar or identical inputs. You may not use the Healyn Application to lead any third party to believe that the Output was produced solely by a human.
Furthermore, you should not use the Output for purposes that may have legal or substantial effects on individuals, such as making important decisions about any person.
Our Services are not designed, prepared, or developed to be used for the diagnosis, prevention, or treatment of any disease, disorder, or condition, or to replace medical advice, medical support, or psychological counseling, and no such implication is made.
Healyn or Folds is not a medical or health professional in any sense and does not provide services for the diagnosis, examination, or treatment of any medical or health condition. We have no expertise in these areas.
Your use of the Services or other communications provided by us does not create or imply any relationship between a medical professional and a patient (such as a doctor-patient or psychologist-patient relationship).
Healyn or Folds does not provide any emergency services and has no obligation to do so. We have no obligation to contact you or third parties regarding your medical or health condition or treatment. If there is a health emergency, you should contact emergency health services in your area.
If you have any questions about your health, medical, or mental condition, it is always recommended that you consult a professional healthcare provider. You should not neglect, avoid, or delay obtaining professional medical support or advice due to information obtained through the Services.
The User acknowledges that the services offered within the scope of the Application constitute a fully AI-based and simulated communication environment that aims to provide an interaction similar to a psychologist or therapist experience using different "therapist" personas. No information, suggestion, comment, or evaluation provided in this context constitutes professional service, diagnosis, or treatment provided by an actual psychologist, psychiatrist, psychological counselor, or mental health professional.
All content provided through the Application and responses given by "therapist personas" are not intended and cannot be interpreted as providing psychotherapy, psychiatric examination, clinical evaluation, diagnosis, or treatment services. The Application and the systems behind it are not designed for the diagnosis or treatment of any psychological or psychiatric disorder.
The User acknowledges that they are always obligated to consult a licensed mental health professional or healthcare institution for their mental health needs.
The User acknowledges that they are aware that the AI models used in the Application may occasionally produce incorrect, incomplete, out-of-context, misleading, unsuitable for their personal circumstances, or inappropriate content despite all technical and administrative precautions, and that they use such content entirely at their own risk. Folds is not responsible for any consequences arising from reliance on or dependence on such content.
The Application is not designed for emergencies, crises, life-threatening situations, or situations requiring immediate professional intervention. The User acknowledges that in the event of suicidal thoughts, self-harm intentions, severe depression, psychotic episodes, panic attacks, acute post-traumatic conditions, or similar acute mental health problems, they are obligated to immediately contact emergency health services in their area and that they will not use the Application for such purposes.
For underage users, use of the Application is subject to the permission of their legal representative. Parents or legal guardians acknowledge that the obligation of supervision and oversight during minors' use of the Application lies with them. It is acknowledged that the Application does not constitute child therapy or child psychiatry services.
All Outputs generated by Healyn do not constitute legal opinion, attorney services, consulting, representation, or professional evaluation. Information, comments, suggestions, or evaluations obtained through the Service cannot be accepted as "legal opinion," "legal advice," "attorney opinion," "legal memorandum," or similar professional content in any judicial, administrative, or executive process or by persons and organizations.
The User acknowledges that Folds or Healyn has no responsibility for any decision based on the Output.
Healyn does not provide professional advice in investment, tax, finance, accounting, commercial risk assessment, credit analysis, or financial planning. Outputs should not be used for investment decisions, commercial transactions, financial actions, tax returns, bank or credit applications, insurance transactions, financial liability assessments, or similar transactions with financial consequences.
The User acknowledges that any damages that may arise from transactions they have or have not performed based on the Output are entirely their own responsibility.
The User acknowledges that they are obligated to obtain independent advice from a qualified attorney, financial advisor, independent auditor, investment advisor, or relevant professional expert before making any decision with financial or legal consequences. The User expressly acknowledges that the Outputs provided by Healyn do not replace such professional services.
Outputs generated by Healyn may contain incomplete, erroneous, outdated, misleading, or incorrect interpretations and may not fully conform to actual circumstances. Healyn makes no express or implied warranties regarding the accuracy, reliability, timeliness, legal validity, applicability, or consequential nature of the Outputs.
The User irrevocably acknowledges that they are exclusively and fully responsible for any damages that may arise if they rely on Output obtained from Healyn in any action, decision, transaction, or process with financial or legal consequences, and that Folds accepts no liability in this regard.
The User is responsible for evaluating the suitability of the Output with respect to applicable law, regulations, professional rules, or contractual obligations. Folds has no obligation for auditing, verification, or compliance in this regard.
We may unilaterally change and update our Terms and Conditions from time to time. Therefore, you are advised to periodically review this page for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes will become effective on the date they are published. The User is obligated to follow these changes and updates, and if the User approves these changes or continues to use the Healyn Application after their publication, the User shall be deemed to have accepted such changes.
By entering into these Terms and Conditions, the User acknowledges that they will not acquire any title or status such as representative, officer, agent, commercial representative, shareholder, solution or business partner, dealer, or the like of Folds. Therefore, the User may not disclose any statement that could be interpreted as such in any document, brochure, advertisement, website, or references to or with third parties.

These terms and conditions legally constitute a contract between you as the User and Folds. Please carefully read all terms and conditions and the scope of other Folds Services. By Use (as defined in Article 1.1), you agree to the terms set forth under these Terms and Conditions, including the Folds End User License Agreement and Privacy Policy. If you do not accept the Terms and Conditions (including the Folds End User License Agreement and Privacy Policy), do not use the Folds Application. Your continued Use confirms that you accept the Terms and Conditions.
Folds, a company based in Istanbul/Turkey, offers you as the user (User) the Folds Application, its branded mobile applications, and all related documentation (a list of which can be found on the Apple App Store and/or Google Play). Each is referred to as a "Folds Application" and collectively as "Folds Applications."
Each time you use or access the Folds Application, you agree to be bound by these terms of service. These terms and conditions apply to products and services offered by Folds through the Apple App Store, Google Play, or any other online platform. Each is referred to as a "Folds Service" and collectively as "Folds Services."
"Use" or "to use" means to access, register, use, install, download, copy, make in-app purchases, or otherwise benefit from the functionality of the Folds Applications. You should carefully read this End User License Agreement before accessing or using any Folds Application.
Each time you use or access the Folds Services, the current version of these terms will apply. This Agreement also covers additional payment terms, in-app purchase options, and other requirements specified on the platform where you download or purchase the Folds Applications.
Your use of the Folds Services is subject to Folds' Privacy Policy. Additionally, you agree to comply with rules, policies, and procedures that may be published on the Folds Services from time to time. These terms may be changed without prior notice.
You agree that notifications made through in-app messages when you open, use, or access the Folds Applications constitute a reasonable method of notification. Your continued use of the Folds Applications after the publication of changes means you accept those changes. If there is a change you do not accept, you should stop using the Folds Applications.
For the avoidance of doubt, all provisions referring to Folds Applications and Folds Services in this Agreement are general terms and conditions relating to Folds' products and services. These provisions are binding on the User but grant rights to the User only with respect to the Healyn Application.
This Agreement cannot be interpreted as granting the User any rights with respect to other Folds Applications or Folds Services.
THIS AGREEMENT IS A LEGALLY BINDING CONTRACT. IF YOU DO NOT UNDERSTAND THIS AGREEMENT OR DO NOT AGREE TO BE BOUND BY THIS AGREEMENT OR THE PRIVACY POLICY REFERRED TO HEREIN, YOU SHOULD IMMEDIATELY LEAVE THE APPLE APP STORE AND/OR GOOGLE PLAY, AND YOU ARE NOT AUTHORIZED TO USE OR ACCESS THE FOLDS SERVICES IN ANY WAY.
Depending on the laws of the jurisdiction where you reside, you may have certain rights that cannot be waived through this Agreement and that are supplementary to the provisions of this Agreement, and certain provisions of this Agreement may not be applicable to you. To the extent that any provision or condition of this Agreement is unenforceable, the remainder of the Agreement will continue in full force and effect.
Under this Agreement, you confirm that you are at least 18 years old (or if you are under 18 or below the required legal capacity age in your location, that you are using the Apple App Store and/or Google Play only with the approval of your parent or legal guardian), that you are legally capable of accepting this Agreement, and that you have fully read, understood, and agreed to be bound by this Agreement.
Please note that to use Google Play, you must have a valid Google account subject to relevant age restrictions and comply with additional age restrictions that may apply to the use of special content or features on Google Play.
Subject to the provisions of the General Data Protection Regulation (GDPR), we do not permit persons under the age of 16 residing in the European Economic Area to use the Healyn Application to the extent prohibited by applicable law.
By approving your child to download, install, use, access, register, or make in-app purchases through the Folds Applications, you accept the terms of this Agreement on behalf of your child. You are responsible for supervising your child's online and offline activities and omissions.
If you do not accept this Agreement, please do not allow your child to use the Folds Applications or related features. If you are the parent or legal guardian of a child under 18 and believe your child has used the Folds Applications without your permission, please contact us at support@folds.co.
This Agreement is entered into between you as the User who downloads and/or installs through the Apple App Store and/or Google Play and Folds, and has mutually entered into force with the User's online approval. Folds and the User shall hereinafter be referred to separately as "Party" and collectively as "Parties."
By downloading and/or installing the Healyn Application through the Apple App Store or Google Play, the User acknowledges, represents, and warrants that they have read all the terms contained herein, understood their content, and approved all provisions.
If the User is considered a "consumer" under applicable consumer protection legislation, it is acknowledged that they may benefit from the rights and authorities granted to consumers to the extent applicable.
The User acknowledges and represents that they must properly inform Folds to exercise consumer rights and that they will act in compliance with applicable legislation in this regard.

Subject to your compliance with the terms of the Agreement, Folds grants you a limited, non-exclusive, revocable, non-sublicensable, and non-transferable license to access, download, and install the most current version of the Healyn Application available to the general public on a single, permitted mobile device that you own or control, solely for your lawful, personal, end-user, and non-commercial use.
For the avoidance of doubt, all Folds Applications are protected by copyright laws, international copyright treaties, and other intellectual property legislation. Folds is the exclusive owner of all software, designs, source code, object code, directories, images, and content contained in the Folds Applications.
Folds reserves all rights not expressly granted to the User in accordance with Article 11 of this Agreement. Folds retains ownership of the Folds Applications and the copyrights therein.
The User may not reproduce, copy, distribute, or process advertisements, images, texts, audiovisual content, files, databases, catalogs, and lists contained in the Folds Application. The User may not rent or lend the Folds Applications to any person and may not permanently transfer all of their rights under this Agreement.
Folds is not responsible for the consequences of using Folds Applications obtained through an illegal or unauthorized distributor.
Users acknowledge, represent, and warrant that when using the Folds Applications, they will not engage in actions that are contrary to law, morality, or that could harm the opportunity to benefit from the Folds Services.
In the event of the User's violation of this article, Folds reserves the right to terminate the Agreement pursuant to Article 14, temporarily or permanently block the User's access to the Folds Applications, and pursue legal or criminal remedies.
The User may not rent, sell, sublicense, distribute, transfer, or copy the Folds Applications or rights arising therefrom (except for a single copy for backup purposes only).
Unless expressly authorized by Folds, the User is prohibited from making the Folds Applications available for use on a network accessible by multiple users.
The User agrees not to interfere with the proper functioning of the Folds Applications using robots, spiders, or automatic or manual tools, and not to share illegal, harmful, virus-infected, or malicious content.
The User may not copy, adapt, translate, decompile, reverse engineer, disassemble, modify, or create derivative works of the Folds Applications.
All modifications or improvements made to the Folds Applications shall remain the exclusive property of Folds. The User agrees that they shall be responsible for any damages incurred by Folds or third parties.
Folds may restrict or terminate access to the Folds Applications without prior notice when network security is at risk, to ensure service continuity, or in other cases deemed necessary.
Folds reserves the right to add or remove features or functionality from the Folds Applications. Updates may be made automatically or through notification and may be completed all at once or in multiple sessions.
The User acknowledges that Folds has no obligation to support previous versions and that updates may be mandatory regardless of Google Play or Apple App Store settings.
The User is responsible for procuring at their own expense the devices, equipment, internet connections, and service plans required to access the Folds Applications. Folds does not guarantee access on all devices or all service plans.
Ensuring the security of account information is the responsibility of the User, and personal data belonging to Apple App Store or Google Play users cannot be collected through these platforms.
Certain Folds Applications may be purchased through the Apple App Store or Google Play or may include in-app purchases. Cancellation and withdrawal rights are subject to the legislation of the country where the User resides and the conditions of the relevant platform.
Applicable withdrawal rights are reserved for Users residing in the European Union; however, these rights may be deemed waived after the application is downloaded or delivered. Subscriptions and in-app purchases are also within this scope.
Detailed information regarding order cancellations and refunds can be obtained through the Apple App Store or Google Play platforms. In this regard, the provisions of Article 13 of the Agreement should also be taken into account.
After the Folds Applications are made available for your use through your account, you should check the content as soon as reasonably practicable to ensure that the Folds Applications function and operate as specified. If you discover any errors or defects, you should notify us or Google Play / App Store as soon as reasonably practicable.
Without prejudice to other rights, Folds may terminate this Agreement if the User fails to comply with the provisions of this Agreement and other documents referred to herein. In such a case, the User is obligated to remove or delete the Folds Applications. In this regard, the provisions of Article 14 of the Agreement should also be taken into account.
The Folds Applications allow the use of various features, functions, and other Folds Services ("Folds Applications Functions") that may change from time to time. These functions may be provided by Folds and third-party providers ("Third-Party Business Partners") that provide content and/or services in connection with or through the Folds Applications.
The Folds Applications may be integrated with or offered in connection with third-party services, advertisements, broadcasts, and/or content. The User acknowledges that third-party services and content are subject to the respective Third-Party Business Partners' own terms of service and privacy policies.
Folds has no control over these third-party websites and resources. The User acknowledges that Folds is not responsible for any damage or loss that may arise from reliance on or use of such content or services. Folds is not a party to monitoring transactions between the User and Third-Party Business Partners and accepts no responsibility for such transactions.
All data, links, articles, graphics, videos, software, music, sounds, and other materials ("Content") provided through the Folds Applications are the responsibility of the person or organization that created them.
The User represents that they may be exposed to offensive, objectionable, or inappropriate Content when using the Folds Applications and that they accept all risks relating to the use of Content. Folds is not responsible for any loss or damage that may arise from Content created by third parties or from the transmission, sharing, or publication of such Content.
All links to third-party applications or websites are provided solely for convenience and are subject to the relevant third parties' terms. Folds is not responsible for these websites, products, or services. The User is obligated to review and comply with the rules and conditions of such third-party platforms.
The Folds Applications may not be 100% secure, like other technologies in the relevant market. By accepting this Agreement, you acknowledge that the Folds Applications and information downloaded or shared through these applications may be subject to unauthorized access, corruption, damage, or misuse.
Responsibility for such security risks and any damages arising therefrom lies with the User. The User is exclusively responsible for protecting their mobile device from unauthorized access and cyber attacks through methods such as using complex passwords. Folds is not responsible for unauthorized access to your mobile device or application data.
Google may collect information about network connections, potentially harmful URLs, operating systems, and applications installed from Google Play or other sources to provide protection against malware. Google may warn the User about applications or URLs it considers unsafe or may block or remove installation of applications known to be harmful.
The User acknowledges that they may disable some of these security measures through device settings; however, security analyses regarding applications installed through Google Play may continue.
Most Folds Applications do not require registration. However, some Folds Applications may request or require you to create an account to access certain features or functions ("Registration").
If registration is required, you will be notified when you attempt to participate in or access the relevant features. Registrations required by Third-Party Business Partners are not subject to this Agreement and are subject to the relevant third parties' own policies and terms.
Protection of passwords and credentials created or selected by you is exclusively your responsibility. You are obligated to maintain the confidentiality of your passwords and credentials.
You are fully responsible for all transactions carried out through your password or credentials. In the event of loss, theft, leakage, or unauthorized use of your password or credentials, you must notify us immediately.
We reserve the right to suspend or terminate your account if there is reasonable suspicion that password security has been compromised. We are not responsible for any damages arising from misuse of password or credentials.
Information you provide during registration must be accurate, complete, and current. If there is reasonable suspicion regarding the accuracy of this information, we may suspend or terminate your use of the Application.
Information provided to us will be used in accordance with the Privacy Policy and for the purposes specified in this Agreement.
The User may benefit from the basic functions of the Folds Application without registering. However, additional features may be accessed by registering through third-party authentication methods such as Google, Apple, or email.
All transactions carried out through an authenticated account are deemed to have been made by the User. Folds cannot be held responsible for any damages arising from security breaches or User negligence.
Removal and deletion of Folds Applications may vary depending on the device used. The application manager or device guide for your device should be used for these operations.
Technical data relating to the device, system, and application software may be collected and used in accordance with the Privacy Policy for the purpose of providing software updates, product support, and services.
Reviews made through application stores or social media channels may become publicly available. For security reasons, passwords, identification numbers, or payment information should not be shared.
Folds has the right but not the obligation to remove inappropriate content.
Reviews made through Google Play or the App Store are subject to the relevant platforms' own policies and terms.
All intellectual property rights in all software, content, design, brands, logos, data, code, and know-how provided within the scope of Folds Services belong exclusively to Folds.
Intellectual property rights include all rights such as patents, trademarks, copyrights, trade secrets, and similar rights. All rights not expressly transferred belong to Folds.
The use of intellectual property rights relating to services provided to the User by Folds is at Folds' discretion unless otherwise agreed.
The User is responsible for all content provided by the User. It is the User's obligation to ensure that the content is legal and does not infringe the rights of third parties.
Folds handles notices of alleged copyright infringement appropriately and reserves the right to terminate access for repeated infringements.
Content that is illegal, harmful, discriminatory, obscene, violent, or of similar nature is considered inappropriate and may be removed at Folds' discretion.
Folds is not obligated to pre-screen all content, but may monitor, edit, or remove content when deemed necessary.
The User may not use any software to copy, save, or remove watermarks from streaming or in-app content.
In the event of repeated infringements, Folds reserves the right to terminate the User's access to the Applications.
Folds attaches great importance to copyrights, personal data, privacy, and intellectual property rights. Users acknowledge and undertake to comply with the principles set forth in this Agreement and other documents provided by Folds when using the Folds Applications.
Users may only upload materials that they own or are authorized to use to the Folds Applications. Users acknowledge and undertake not to infringe any rights of other Users under this Agreement.
If you believe in good faith that any material transmitted or created through the Folds Application infringes your copyright, personal rights, or privacy, you may submit a notification to Folds by filling out the infringement form and request removal of the relevant material or blocking of access.
Folds Applications may be offered through the Apple App Store and/or Google Play, or directly by Folds through an internet browser for certain membership models. Purchase and payment processes may vary depending on the platform used.
Some features are offered through in-app purchases. Payment is required to access these features.
In-app purchases may be offered as annual, semi-annual, quarterly, monthly, or weekly subscriptions and may be automatically renewed until canceled by the User.
Payments are processed by the Apple App Store and/or Google Play. Management of in-app purchases is entirely the responsibility of the User.
To make purchases through Google Play, you must have a Google Payments account and accept the relevant terms. The User is exclusively responsible for payments relating to all purchases made through Google Play.
Google Play may transmit device information to your network provider to determine the suitability of carrier billing. This information is processed in accordance with Google's Privacy Policy and Google Payments Privacy Notice.
Users under the age of 18 require the permission of their legal representatives to make in-app purchases. By making a purchase, you represent that you have the necessary permissions.
In-app purchases are billed by the Apple App Store or Google Play, not by Folds. Refund and billing requests should be directed to the relevant platforms.
For technical issues not caused by the User or the User's device, the necessary investigation will be conducted upon notification. For such situations, please contact healyn.app@folds.co.
You acknowledge that all payment and billing processes are conducted by the Apple App Store and/or Google Play and are subject to these platforms' own terms and conditions.
This Agreement enters into force on the date of approval and remains in effect as long as the User uses the Healyn Application.
In the event of the User's violation of this Agreement, applicable legislation, or Apple App Store and/or Google Play rules, Folds may unilaterally terminate the Agreement without any liability for compensation.
Upon termination of the Agreement, the User must immediately cease using the Healyn Application and remove or destroy all copies from their devices.
Termination does not limit Folds' other rights and claims arising from legislation.
You agree to indemnify and hold harmless Folds, its affiliates, and the officers, directors, licensors, partners, shareholders, licensees, contractors, agents, attorneys, employees, and third-party service providers of Folds and its affiliates (collectively "Indemnified Parties") from all claims, liabilities, costs, and expenses (collectively "Claim(s)"), including reasonable attorney's fees, arising from or alleged to arise from information you provide, your use of the Folds Services, or your breach of this Agreement, whether directly or indirectly.
Subject to the relevant Indemnified Party's right to participate in the process with an attorney of their choice, you agree that you are exclusively responsible for defending any Claim brought against or suffered by any Indemnified Party and for paying any damages or losses arising from claims brought against any Indemnified Party, provided that you do not accept any agreement that imposes any liability or obligation on any Indemnified Party without the prior express written consent of Folds.
To the extent permitted by applicable law, all Folds Applications are provided on an "AS IS," "WITH ALL FAULTS," and "AS AVAILABLE" basis, and you use them at your exclusive risk. Subject to applicable law, Folds, on behalf of itself and its affiliates, licensors, distributors, vendors, agents, and suppliers, expressly disclaims all warranties, express, implied, or statutory, including but not limited to warranties of merchantability, non-infringement, and other warranties arising from applicable legislation.
Without limitation, Folds makes no warranty that the Folds Applications will meet your requirements, be uninterrupted, timely, secure, or error-free, that results obtained from the use of Folds products will be accurate or reliable, or that the quality of the Folds Applications will meet your expectations.
Folds accepts no liability or responsibility for material damages of any nature arising from your access to and use of the Folds Applications in the following situations: unauthorized access to or use of our secure servers and/or all personal and/or financial information stored therein; interruption or cessation of transmission to or from the Folds Applications or servers; any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the Folds Applications by any third party; or any errors or omissions in any content or any loss or damage incurred as a result of the use of any content sent, e-mailed, transmitted, or otherwise made available through the Folds Applications.
Some Folds Applications may allow you to record phone calls on your Android or iOS device. Some local, state, federal, and international laws prohibit the recording of third-party voices without the consent of all parties to such recording. You are exclusively responsible for complying with all local, state, federal, or international laws regarding call recording and for obtaining the necessary consent. Folds shall in no event be liable to you or third parties for your failure to comply with local, state, federal, or international laws regarding third-party voice recording.
All risk arising from the use or performance of the Folds Applications lies exclusively with you. Folds expressly disclaims all warranties relating to products and/or services provided by Third-Party Business Partners. This warranty disclaimer constitutes an essential part of this agreement.
To the extent permitted by applicable law, you expressly understand and agree that Folds shall not be liable for any direct, indirect, incidental, special, consequential damages, or punitive damages, including but not limited to loss of profits, reputation, use, and data, or other intangible losses arising from (i) the use or inability to use the Folds Applications; (ii) unauthorized access to or alteration of your transmissions or data; (iii) statements or conduct of any third party; or (iv) any other matter relating to Folds.
In no event shall Folds' total liability to you for all damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed the amount you paid to access the Folds Application. The above limitations shall apply even if the above remedy fails of its essential purpose.
Nothing contained in this Agreement shall be deemed or construed as creating an employee/employer relationship pursuant to applicable labor laws.
In all cases that legally constitute force majeure, Folds cannot be held responsible for its failure to perform or late or incomplete performance of its obligations under this Agreement. Such deficiencies shall not be considered default or incomplete or defective performance, and no claims for compensation shall be made against Folds in this regard.
The term "force majeure" herein refers to any event beyond the reasonable control of the affected party and unavoidable despite reasonable care by Folds, including but not limited to natural disasters, riots, uprisings, disturbances, wars, communication disruptions, infrastructure and internet network failures, power outages, mobilizations, strikes, fires, explosions, terrorism, cyber attacks, prolonged and widespread power outages, internet outages, computer viruses, legislative changes, and adverse weather conditions.
The User shall in no way accrue default interest or claim compensation due to delay, incompleteness, or non-performance of any of the provisions of this Agreement due to force majeure.
This Agreement and legal relationships arising from this Agreement shall be governed by and construed in accordance with the laws of Turkey. The CISG shall not apply to this agreement. Turkish Courts (Istanbul (Caglayan) Courts and Enforcement Offices) shall have jurisdiction over all actual or potential disputes arising from this Agreement. You shall be deemed to have consented to the jurisdiction and venue of such courts to the fullest extent permitted by law and to have waived your right to object to such jurisdiction and venue.
These Terms constitute the entire agreement between you as the User and Folds regarding the use of the Folds Application and Services and supersede all prior or contemporaneous agreements on this subject.
No amendment or modification to this Agreement shall be binding unless in writing and signed by Folds. Failure by either party to exercise any rights granted hereunder or to take action against the other party in the event of a breach shall not constitute a waiver of subsequent exercise of rights by the other party or of subsequent actions in the event of future breaches.
In the event that this Agreement is translated for local requirements and there is a discrepancy between the English and non-English versions, the English version of this Agreement shall prevail to the extent not prohibited by law.
If any term or provision of this Agreement is declared invalid or unenforceable in any particular case by any judicial or administrative authority, such declaration shall not affect the validity or enforceability of the remaining terms and provisions or the validity or enforceability of the defective term or provision in any other case. The provision shall be construed and applied to the fullest extent legally permitted for the realization of the original purpose; and if such construction or application is not legally permitted, it shall be deemed severed from the terms.
